Milored Trkulja, an entertainment promoter who is now 62, was shot in the back in 2004 in a crime that was never solved. He accused Google of defaming him with material he said imlied he was a major crime figure in Melbourne and had been the target of a professional hit.</div>

Searches of his name brought up references to the city's gangsters including crime boss Tony Mokbel and a now defunct site called ''Melbourne Crime'' chronicling gang-related incidents.</div>

Google denied publication in the Supreme Court of Victoria, saying it had innocently disseminated material published by others, and also disputed that the materail conveyed the defamatory implications claimed by Trkulja.</div>

But a jury ruled in his favour, finding the Internet firm had been on notice failed to act on the issue from October 2009, when Trkulja's lawyers wrote to them demanding action over the ''grossly defamatory'' content.</div>

Judge David Beach ordered Google to pay Trkulja Aus$200,000 likening their role in publication to a library or newsagent, which have ''sometimes been held to be publishers for the purposes of defamation law'' in Australia.</div>

''Google Inc is like the newsagent that sells a newspaper containing a defamatory article,'' Beach said in his judgement. ''While there might be no specific intention to publish defamatory materail, there is a relevant intention by the newsagent to publish the newspaper for the purposeof the law of defamation.''</div>

Beach said the jury was ''entitled to conclude that Google Inc intended to publish the material that its automated system produced, because that was what they were designed to do upon a search request''.</div>

<b>Astronomers have found a new planet, the closest yet outside our solar system and just an astronomical stone's throw away at four light years, raising the chances of finding a habitable planet in Earth's neighborhood.</b></div>

Researchers say the new planet is too close to its sun to support known forms of life, with a surface temperature estimated at 1,200 degrees Celsius (2,192 Fahrenheit). But previous studies suggest that when one planet is discovered orbiting a sun, there are usually others in the same system.</div>

The new Earth-sized planet, announced in science journal Nature by Stephane Udry and Xavier Dumusque at the Geneva Observatory, orbits one of the suns in Alpha Centauri, ruoghly 25 trillion miles away.</div>

"It's a landmark discovery because its very low mass and it's our closest  neighbor." said Udry. "Its orbit is very close to its star and it must be much too hot for life as we know it but it may well be just one planet in a system of several."</div>

Commenting on the find, University of California astronomer Greg Laughlin said: "This is our back yard, so to find out that planet formation occurred there is just extraordinary."</div>

Since the discovery of the first exoplanets - those outside our solar system - in the early 1990s, more than 800 have been found but this one is the closest to Earth.</div>

It was detected using the HARPS instrument on a telescope at the European Southern Observatory's La Silla site in Chile. The device is able to pick up tiny changes in the color of the light coming from a host star as it wobbles under the gravitational influence of orbiting planets. </div>

Hatzes said the wobble detected in the star could be caused by a serious of other factors, including sun spots, so the data need to be tested by other researchers.</div>

"These activity variations have to be filtered from the data before one can extract the signal due to the possible planet," he siad. "It could well be that someone else analyzing the same data may come up with a different conclusion. That is why I am not 100 percent certain."</div>

But Dumusque is confident. "We have considered in this analysis all the known possible explanations, including instrumental noise and stellar origin. In the end, the planetary solution is the most likely one."</div>
